देहरादून: जिलाधिकारी सविन बंसल जन शिकायत पर कड़ा एक्शन लेते हुए, *शराब की दुकान को 15 दिन के लिए निलंबित करने के आदेश दिए।* राजपुर रोड बहल चौक स्थानीय निवासी महिलाओं एवं बुजुर्गों द्वारा जिलाधिकारी को प्रतिदिन संचालित जनता दर्शन कार्यक्रम के दौरान शिकायत कि गई ओपन लाज बिल्डिंग स्थित शराब की दुकान पर खुले में शराब पिलाए जाने तथा की शिकायत पर जिलाधिकारी ने एसडीएम सदर को कार्यवाही के निर्देश दिए।
अवैध रूप से बार संचालन की स्थानीय निवासियों की शिकायत पर डीएम ने कराई थी जांच।* इससे पूर्व टीम द्वारा तत्काल छापेमारी कर समस्त अवैध दुकानों को ओपल लॉज के बाहर से हटाया गया। *ओपल लॉज के बेसमेंट में चल रहे अवैध शराब सेवन स्थल को तत्काल बंद करवाते हुए ₹500000 की चालानी कार्रवाई की गई थी।
उपजिलाधिकारी न्यायिक सदर देहरादून के माध्यम से प्रेषित संयुक्त निरीक्षण रिपोर्ट में उल्लेख किया गया कि दी ओपल लॉज बिल्डिंग के बेसमेंट में अवैध रूप से एक बार का संचालन होना पाया गया। मौके पर शराब सेवन हेतु टेबिल तथा काफी मात्रा में सिंगल यूज प्लास्टिक के कप, ग्लास एवं कचरा भी पाया गया। उक्त के कम में पुनः बिल्डिंग के बेसमेंट में संचालित अवैध शराब सेवन स्थल के स्वामित्व के सम्बन्ध में विस्तृत जांच उप जिलाधिकारी सदर न्यायिक, जिला आबकारी अधिकारी तथा नगर निगम देहरादून की संयुक्त टीम द्वारा की गई।
जांच में यह पाया गया कि दी लीकर हब (विदेशी मदिरा की लाईसेंसधारक दुकान) द्वारा मौके पर शराब बिक्री के अतिरिक्त आसपास कई अवैध दुकानें /खोखे लगवाकर शराब सेवन हेतु सिंगल यूज प्लॉस्टिक के ग्लास एवं कप, बर्फ, नमकीन के पैकेट, सिगरेट आदि सामग्री विकय करवायी जा रही है। बिल्डिंग के बेसमेंट में शराब सेवन हेतु बड़े डेस्क भी प्राप्त हुए। स्थानीय निवासियों एवं महिलाओं द्वारा पूछताछ करने पर यह ज्ञात हुआ कि सायं एवं रात्रि के समय बिल्डिंग के बेसमेंट में शराब सेवन हेतु कैन्टीन भी चलायी जाती है। चूँकि दी लीकर हब ही उक्त स्थल पर शराब बिकी हेतु एकमात्र लाईसेंस दुकान है। *पूर्ण सम्भावना है कि शराब बिकी के पश्चात उक्त दुकान द्वारा ही लोगों को बेसमेंट पर शराब सेवन हेतु अनुमति दी जा रही है, जिस बात की पुष्टि स्थानीय नागरिकों एवं महिलाओं द्वारा भी की गई है।
मौके पर बेसमेंट में अत्यधिक मात्रा में शराब की बोतलें तथा सेवन हेतु उपयोग में आने वाली कप एवं गिलास भी प्राप्त किये गए। ओपल लॉज बिल्डिंग में संचालित दो अन्य बार दी ओपल बार एवं रेस्टोरेंट तथा बी वाई ओ बी का निरीक्षण करने पर पाया गया कि दोनो के पास नियमानुसार लगभग 80 लोगों के बैठने की क्षमता है। उक्त तथ्यों की पुष्टि स्थानीय महिलाओं निवासियों ने बताया गया कि मदिरा दुकान द्वारा परिसर तथा परिसर से बाहर रात्रि 12 बजे के बाद तक भी मदिरा बिक्री एवं शराब का सेवन कराया जाता है। जो कि पिछले 03 वर्षों से स्थानीय महिलाओं, बच्चीयों एवं स्कूल जाने वाली छात्राओं के लिये एक निरन्तर समस्या बना हुआ है।
आबकारी नीति, 2024 के बिन्दु संख्या 10.1 के अनुसार देशी/विदेशी मदिरा दुकानों के खुलने का समय प्रात 09 बजे से रात्रि 11 बजे तक रहेगा। अन्तर्राज्य सीमा के 10 किमी की सीमा में स्थित मदिरा दुकानें रात्रि 12 बजे तक खोली जा सकेगी। तथा आबकारी नीति 2024 के बिन्दु संख्या 6.6 के अनुसार विदेशी मदिरा के खुदरा दुकान पर निर्धारित शर्तों के अधीन एफ0एल0-5डी० लाईसेंसी द्वारा दुकान की चौहद्दी से लगे परिसर में मदिरा उपभोग की व्यवस्था अनिवार्य रूप से करनी होगी, जिसके लिये एफ०एल०-5ई० लाईसेंस (कैंटीन) लेना होगा। जिसकी लाईसेंस फीस दुकान की लाईसेंस फीस के 15 प्रतिशत के बराबर होगी।
संयुक्त निरीक्षण के दौरान सम्बन्धित मदिरा दुकान के अनुज्ञापी द्वारा आबकारी नीति 2024 का उल्लघंन पाया गया है जो कि अनुज्ञापी को दिये गये आंवटन पत्र की शर्तें भी है। संयुक्त निरीक्षण टीम द्वारा अवैध रूप से बेसमेंट में अस्थाई बार एवं शराब सेवन स्थल का संचालन तथा निर्धारित समयावधि से अधिक समय तक मदिरा की दुकान का संचालन एवं विक्रय कराने के कारण दि लीकर हब, विदेशी मदिरा दुकान राजपुर रोड़-3 निकट सचिवालय के अनुज्ञापी विमलेश कुमार के विरूद्ध दण्ड स्वरूप उत्तराखण्ड आबकारी मैन्युअल खण्ड-1 की धारा 34 तथा धारा 35 में निहित प्राविधानों के अन्तर्गत 15 दिन के अनुज्ञापन निलम्बन की कार्यवाही की गयी है।
